John Kofi Halm, the National Democratic Congress (NDC) parliamentary candidate for the Trobu constituency, has filed a lawsuit seeking to nullify the election results that declared Gloria Owusu of the New Patriotic Party (NPP) as the winner of the December 7, 2024 parliamentary elections.
The suit, filed by Mr. Halm, names several respondents, including the Electoral Commission (EC) Headquarters, the EC’s Trobu District Office, and the Clerk of Parliament. In his legal challenge, Halm cites alleged irregularities and discrepancies in the electoral process that he claims undermined the integrity of the election.
In the parliamentary race, Gloria Owusu received 43,789 votes, defeating Halm, who garnered 35,147 votes. However, Halm and his legal team argue that the election results should be invalidated due to inconsistencies found in the pink sheets, particularly for 98 out of 288 polling stations in the Trobu constituency.
Represented by lawyer Nii Kpakpo Samoa Addo, Halm contends that the election was not conducted in accordance with Ghana’s electoral regulations, specifically Regulations 39 of the Public Elections Regulations, 2020 (C.I. 127). He claims that the alleged non-compliance affected the election results.
The legal team has pointed to significant discrepancies between the official results recorded on the pink sheets and the actual votes counted at polling stations. They argue that these irregularities are serious enough to render the results unreliable. Furthermore, they allege that the EC failed to address these issues before declaring Owusu as the winner, which they argue violates the EC’s mandate to ensure free, fair, and transparent elections.
Halm is now seeking the court’s intervention to nullify the election results and ensure compliance with the country’s electoral laws.
