The High Court is set to rule on a legal challenge filed by former Director-General of the National Signals Bureau (NSB), Kwabena Adu-Boahene, and his wife, Angela Adjei Boateng, against the Attorney-General and the Economic and Organised Crime Office (EOCO) over what they describe as “unjustifiably harsh” bail conditions.

The couple, who remain in custody, argue that the GH¢120 million bail set for Adu-Boahene and the GH¢80 million for his wife are excessive and appear intended to extend their detention beyond constitutional limits.

“The Respondents, with a clear motive to incarcerate the Applicants beyond the 48 hours as spelt out by the Constitution, have imposed burdensome and unreasonable conditions on the Applicants as the precondition for their granting them bail,” their lawyers argued in court filings.

They further claim that the conditions violate their clients’ rights to liberty, stating, “The justification of the bail is at the pleasure of the Respondents.”

The legal battle has sparked debate over the fairness of bail conditions in high-profile cases, with the couple’s defense team accusing the state of obstructing due process. The court’s ruling on the matter is expected to set a precedent for similar cases in the future.
